- Summary
- "In his familiar study General Principles,1 Cheng did not refer to abuse of right as a 'principle', but a theory. Indeed, the words 'abuse of right' seek to convey nothing more than a concept. They cannot literally define a principle any more than the two words 'negligence' or 'murder' could do so. To state a principle, one would have to add something like '... is wrong', or depending on the context, '... unlawful'. (That this may be obvious, given the pejorative connotations inherent in the word 'abuse', is another matter.)"--
