The issue was whether the addition by an online business of a generic top-level domain (".com") to an otherwise generic term can create a protectable trademark. BOOKING.COM B.V. was denied registration by the United States Patent and Trademark Office. The United States District Court for the Eastern District of Virginia held that BOOKING.COM is not generic and potentially protectable as a trademark. That decision was upheld by the United States Court of Appeals for the Fourth Circuit. The United States Supreme Court reversed the decision stating that booking.com is a generic term and that a business cannot obtain a monopoly on a generic term
